A Lusaka businessman is appearing in Kapiri Mposhi Magistrates’ court for causing death by dangerous driving.
Before Kapiri Mposhi Magistrate, Mwila Malupande, was Madubansi Mainza 45, of Avondale residential area is facing one count of causing the death of Chellah Ndashe 88, of Kampoyo area in Kapiri Mposhi District.
Particulars of the offence were that on 7th January 2019, Mainza while driving a Toyota Allion motor vehicle, registration Number BCC 5006, along the Kapiri Mposhi-Ndola highway, did cause the death of Ndashe.
The incident happened when the accused allegedly drove his motor vehicle dangerously in a manner which was dangerous to the public and without regard to other road users.
This is contrary to Section 161 of the Road Traffic Act Number 11 of 2002 of the Laws of Zambia.
The victim died on the spot after being hit.
Magistrate Mwila Malupande has committed Mainza to the Kabwe High Court for plea and possible trial.
