The Kaoma magistrate court has today sentenced a popular local musician to two and half years imprisonment for theft.
Lubinda Banda of Nkeyema, popularly known as ‘Man Ruby’, was found guilty of one count of theft by Magistrate Justin Phiri.
Facts before the court were that on December 7, 2018, between 01:00 hours and 05:00 hours, Banda did break into Mr. Jericho Kapenda’s shop in Nkeyema and stole two solar panels and assorted groceries all valued at K2,500.
Magistrate Phiri found Banda guilty of the offence upon his own admission.
In mitigation, Banda asked the court to forgive him in the name of Jesus saying he is keeping a disabled child.
Banda further asked the court to be lenient on him saying if he is sent to prison, the disabled child would suffer.
And in passing judgment, Magistrate Phiri said he considered that Banda was a first offender and was aware of the impact of the offender’s music in the community.
Magistrate Phiri however noted that the offence which Banda committed was serious and needed a sentence that would deter would be offenders.
Magistrate Phiri then slapped Banda with a 30-months prison sentence effective the day of arrest.
